The Tragedy of Wrongful Deaths Involving Children

Posted on December 25th, 2014 by Admin

When a family member dies unexpectedly because of another person’s negligence or wrongdoing, families suffer great loss.  Yet, there is perhaps no greater tragedy than a child who unnecessarily dies because of a criminal action or because someone neglects to provide the proper safety measures, supervision or care.  Children should have their whole lives ahead of them, and families can be devastated by a wrongful death.  While the legal system cannot restore a child’s life, it can hold the responsible party accountable.  It can also help relieve financial stress by awarding compensation through the efforts of an experienced wrongful death attorney.  Georgia law protects the rights of surviving family members when a wrongful death occurs.

A 2012 accident typifies this type of tragedy. The Atlanta Journal Constitution (AJC) reported in April 2012 that a 13-year-old Georgia boy was on the roof of a hangar at Peachtree City-Falcon Field Airport.  The boy had gone to work with his mother’s boyfriend who was employed at the airport. He stepped into a skylight, which did not support him, and it broke.  He fell 25 feet to his death.  Airport officials promptly contacted OSHA to investigate the incident.

Under Georgia law, certain family members have the legal right to file for wrongful death and recover damages when another party is liable for their loved one’s death.  The best way to find out about the prospects of pursuing a case is to discuss the matter with an experienced wrongful death lawyer.
